Starting this month, December 2024, USCIS will begin conducting interviews for certain VAWA applicants. Not all applicants will be required an interview. Why is USCIS Making This Change?
USCIS is implementing these interviews as part of their process due to an increased amount of fraud in the VAWA program. There have been an increased amount of attorneys contributing to the issue of fraud, and USCIS believes implementing interviews will help decrease the amount of fraud by addressing any eligibility concerns.
Who Will Be Interviewed?
The only VAWA applicants who will be interviewed at this point in time are those who have BOTH an I-360 petition and an I-485 application currently pending. Individuals who only have an I-360 petition pending will not be interviewed at this time
This is because the I-360 petition is the the first step in the VAWA process. You need an I-360 approval before moving on to the I-485 form to adjust your status.
If you are selected for an interview, DO NOT skip the interview! If you fail to attend the interview it can lead to an immediate denial. If you would like, your attorney can attend the interview with you. In addition, if you need to reschedule your interview date, you can follow the instructions provided on your interview notice.
What To Expect
If you have received an interview notice already, or believe you might receive one, it is important to be prepared. They will ask you about everything submitted in your application: evidence, letters, photos, etc.
Your interview will be conducted by an immigration officer, and you must attend the interview in person. Again, you can have an attorney attend with you!
